DMCA Policy

Planting Our Christmas Tree ("we", "us", or "our") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (the "DMCA"), we will respond promptly to notices of alleged copyright infringement that are reported to our Designated Copyright Agent, identified below.

This policy outlines the procedures for copyright holders to request the removal of allegedly infringing material and for users to file counter-notifications when they believe material has been removed by mistake or misidentification.

Filing a DMCA Notice of Alleged Infringement

If you are a copyright owner, or an agent authorized to act on behalf of one, and you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on our website, please send a written notification ("DMCA Notice") to our Designated Copyright Agent with the following information:

  1. Identification of the copyrighted work: Provide a description of the copyrighted work that you claim has been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  2. Identification of the infringing material: Provide a description of the material that you claim is infringing and where it is located on the Planting Our Christmas Tree website, with enough detail that we may find it. This should include the specific URL(s) where the material can be found.
  3. Contact information: Provide your name, mailing address, telephone number, and email address.
  4. Statement of good faith belief: Include a statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. Statement of accuracy: Include a statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. Signature: Provide a physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

DMCA Counter-Notification Procedure

If you believe that your content was removed or disabled by mistake or misidentification, you may send a counter-notification to our Designated Copyright Agent with the following information:

  • Identification of the removed material: Identify the material that was removed or to which access was disabled and the location (URL) where the material appeared before it was removed or access was disabled.
  • Statement of good faith belief: Include a statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Contact information: Provide your name, mailing address, telephone number, and email address.
  • Consent to jurisdiction: Include a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Planting Our Christmas Tree may be found, and that you will accept service of process from the person who provided the original DMCA notice or an agent of such person.
  • Signature: Provide a physical or electronic signature.
